Empty Properties Privacy Notice

The purpose of processing

To increase the housing stock in Bath and North East Somerset by bringing empty properties back into use. The delivery of affordable housing, prevention of Council Tax fraud, and the prevention of crime and disorder in the community.

Data subjects

The owners of empty properties

Personal data

Address of empty property
Name and current address/contact details of owner
Council tax records and class
Special category personal data: Council tax class E indicates that owner is in residential care so indicates a health issue

How is it used?

Contact is made with the owners (letters, phone calls and face to face meetings)
Empty property inspections
Provision of assistance to prevent enforcement action and bring the property back into use
Loans, grants and VAT reductions are offered as well as advice given regarding options for the re-use of the empty property

Profiling and automated decision making

Not applicable.

GDPR condition relied upon for processing personal data:

Article 6.1 e - Exercise of official authority
Housing Act 2010, Crime and Disorder Act 2014 and the Council Tax Regulations 1992

Article 9.2 g - Substantial public interest

Sharing of personal data with external recipients

Personal data could be shared with estate agents and building contractors, only with full consent from the empty property owner, and only for the purpose of bringing the empty property back into use.

How long is the personal data retained by the Council?

Personal data will only be retained for as long as it is needed for the purpose specified above, or as required by applicable law or regulatory requirements.
