Houses of Multiple Occupation (HMO) Licensing Privacy Notice

The purpose of processing

• To identify the persons in control of the HMO and its management.
• To facilitate legal proceedings in the event of any offence connected with the licensing of the HMO.
• To obtain information needed to assess the fitness and competence of persons involved in the management of the HMO.
• To link properties and persons involved in the management, control and ownership of the HMO and any other relevant HMOs.
• To obtain information concerning the suitability of the property involved to be licensed as an HMO.

Data subjects

• All persons with a legal interest in the licensable HMO.
• Property managers.
• Person or persons in control of the HMO or receiving or benefiting from the receipt of rent.

Personal data

We will collect;
• Your Name,
• Your Address
• Your contact phone number & email
• Your Date of birth
• Your Mortgage information
• Any information present in a DBS Check

How is it used?

We will use this information to:
• Identify the name and contact details of the person in control of the HMO for the purpose of licensing and any improvements required to meet the condition and management standards.
• To make a judgement as to whether you are fit and proper to hold a licence or manage the property.
• To serve legal notices including the HMO licence.

Sharing of personal data with external recipients

Your details may be shared with the Police or Immigration services.
We may be required to provide information to other Government Agencies such as HMRC, the Home Office or the Police.

How long is the personal data retained by the Council?

Personal data will only be retained for as long as it is needed for the purpose specified above, or as required by applicable law or regulatory requirements.
We will retain your name, address, email address and/or telephone number to enable us to establish the ownership of the property and compliance with Housing Legislation. These records will be kept for 8 years after the cessation of your involvement with the licensed HMO.
