Returning Officer Privacy Notice

The purpose of processing

The Returning Officer processes your personal data in order to administer the election process. The Returning Officer is legally responsible for the conduct of the election, including publishing the notice of election and other notices in connection with the election, sending a poll card to every voter who is entitled to receive one, administering the nomination process, printing the ballot papers, providing polling stations and appointing presiding officers and poll clerks, managing the postal voting process, verifying and counting the votes and declaring the result.

Data subjects

Residents in Bath and North East Somerset who are eligible to vote at UK parliamentary elections, local government elections (including Bath & North East Somerset Council and parish council elections), Avon and Somerset Police and Crime commissioner elections, elections of the West of England Mayor, national and local referendums. Candidates and agents at those elections. Staff employed to assist at events in connection with those elections.

Name, address, date of birth and contact details of candidates
Name, address and contact details of election agents and other agents
Name and electoral number of electors subscribing a nomination paper
Name, address and electoral number of electors
Name, address and electoral number of electors voting by post
Dates of birth and signatures of electors voting by post
Name, address and electoral number of electors voting by proxy
Name and address of individuals who have been appointed to vote by proxy
Dates of birth and signatures of electors voting by proxy
Name, address, date of birth, national insurance number and contact details of staff employed to work during an election
Bank details of candidates and agents (for the return of the election deposit)
Bank details of staff employed to work during the election (for the payment of fees)

How is it used?

We will use the personal data to establish someone’s eligibility to vote at elections, to send poll cards and postal vote packs to voters in connection with an election, to check the validity of candidates’ nominations, to prepare the electoral register for the election and the absent voters’ lists.

Sharing of personal data with external recipients

We will share your personal data with our printers in order for them to print poll cards, postal vote packs, electoral registers and absent voters’ lists. The electoral register and absent voters’ lists will be shared on request with political parties, candidates and agents at the election, who are entitled to use them for electoral purposes only.

How long is the personal data retained by the Council?

Personal data will only be retained for as long as it is needed for the purpose specified above, or as required by applicable law or regulatory requirements.
