The legal process
Public rights of way are permanent and protected by law. Only a legal order can remove this status.
A public right of way is still protected by law even if it isn't used very often.
We do not generally support applications for extinguishment orders unless they are part of a wider package with compensating public benefit.
We will only accept standalone applications for extinguishments under exceptional circumstances.
When we may consider removal
We can only make an extinguishment order if we consider that a public right of way is 'not needed for public use'.
In this case, we would disregard any temporary circumstances. These may include factors such as any buildings or other structures preventing or diminishing the use of the way.
