(EXPERIMENTAL) ORDER 2024


NOTICE IS GIVEN that on 17th October 2024 the Bath and North East Somerset Council (the Council) made an experimental order under provisions contained in the Road Traffic Regulation Act 1984 (the 1984 Act), the effect of which is to introduce the following restrictions in Catharine Place, Cavendish Road, River Street Mews, Sion Hill, Gay Street and Winifred’s Lane, Lower Lansdown, Bath.

 

  • Every person causing or permitting a vehicle to proceed in a southerly direction in Gay Street (northern section) shall cause or permit that vehicle, on reaching the junction with George Street, to make a left turn into George Street;
  • Prohibit any vehicle to enter the length of roads specified in Schedule 1 to this Order at any time;
  • Prohibit any vehicle to proceed in the length of roads specified in Schedule 2 to this Order at any time;
  • Prohibit any vehicle to turn right when exiting the length of roads specified in Schedule 3 to this Order at any time; 
  • Prohibit any vehicle to turn left when exiting the length of roads specified in Schedule 4 to this Order at any time; 
  • Revoke Order 1558 (Various Roads, Outer Area, Bath) (General Traffic Circulation) (Consolidation) (Order 2015) permitting two-way traffic flow in the length of roads specified in Schedule 5 to this order;
  • Prohibit any vehicle to park and/or wait At Any Time in the length of roads specified in Schedule 6 to this Order.

The order comes into operation on 1st November 2024 and a copy together with a map and a statement of reasons plus other deposited documents may be inspected at The One Stop Shops at The Hollies, Midsomer Norton / 3-4 Manvers Street, Bath and at the Keynsham Civic Centre, Market Walk, Keynsham during normal office hours.

Any person who desires to question the validity of, or of any provision contained in, the order on the grounds that it is not within the relevant powers or on the grounds that any of the relevant requirements has not been complied with in relation to the order, may, within six weeks from the date on which the order is made, make an application for the purpose to the High Court.

The Council will be considering in due course whether the provisions of the experimental order should be continued in force indefinitely.  Within a period of six months beginning with the day on which the experimental order came into force, or, if that order is varied by another order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force, any person may object to the making of an order for the purpose of such indefinite continuation.  Objections to the experimental order being made permanent, together with the ground or grounds for the objection, should be sent by completion of the online response form at: www.bathnes.gov.uk/lansdownetro.  Any valid objection and representation received will be given consideration.  Please note that all objections and representations received may be considered by the Council in public and that the substance of any objection or representation, together with the name and address of the person making it, could become available for public inspection.
